DartKrux Terms of Use

These Terms of Use govern your use of the DartKrux mobile application (the “Service”), published by The Krux (“we”, “us”, or the “Publisher”). By downloading, installing, or using DartKrux, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old to use DartKrux. By using the Service, you represent that you meet this requirement and that you have read and accepted these Terms and the Privacy Policy.

3. The Service

DartKrux helps you score darts games, manage players, follow turns, save game history, and view statistics. The Application is provided for personal entertainment, training, and scoring assistance. It is not intended for official tournament adjudication unless you independently verify all scores and rules.

You are responsible for entering accurate scores, player information, and game settings. DartKrux may contain mistakes, bugs, or rule interpretations that differ from a specific league, venue, or competition format.

4. Subscriptions

DartKrux is free to download and use for its core features. Some features may be gated behind an optional Premium Subscription.

5. Notifications

DartKrux may ask for permission to send notifications. Notifications are optional and are intended for app-related reminders, such as reminding you before a free trial ends. You can allow, deny, or disable notifications at any time in your Device settings.

Notification delivery is not guaranteed. Device settings, operating system behavior, battery management, network conditions, or Application Store policies may prevent notifications from appearing.

6. Local Data and Backups

DartKrux stores app data locally on your Device, including players, game history, scores, statistics, active games, and preferences. You are responsible for maintaining any backups you want to keep. If you uninstall the Application or reset your Device, locally stored data may be lost.

7. Intellectual Property

The Service, including its source code, design, graphics, logos, icons, app name, and content provided by us, is the exclusive property of the Publisher and is protected by intellectual property laws.

Player names, scores, game history, and other information you enter into the Application remain yours. You are responsible for ensuring that any information you enter is lawful and does not violate another person’s rights.

8. Your Feedback

If you send us suggestions, ideas, or feedback about DartKrux, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to use that feedback to improve the Service, with no obligation to compensate you.

9. Acceptable Use

You agree not to:

DartKrux may contain links to third-party websites or services, including Application Store subscription management pages, legal pages, or support email links. We are not responsible for the content, privacy practices, or terms of these third parties. You access them at your own risk.

11. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you breach these Terms or if continued operation of the Service becomes impractical. Upon termination, your right to use the Service ceases immediately. You can stop using DartKrux at any time by uninstalling the Application.

12. “AS IS” and “AS AVAILABLE” Disclaimer

DartKrux is provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be error-free, uninterrupted, secure, free of viruses, compatible with every Device, or that any data you store in the Application will be preserved. You are responsible for checking scores, game rules, Subscription status, and your own backups.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the Publisher’s total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the total amount you actually paid for the Service in the twelve (12) months preceding the claim, or (b) 100 euros.

In no event shall the Publisher be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of profits, loss of data, business interruption, loss of goodwill, scoring disputes, tournament results, or missed notifications, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, the limitations above apply only to the extent permitted by law.

14. Governing Law

These Terms are governed by French law. If you are a consumer residing in the European Union, you continue to benefit from the mandatory protections of the law of your country of residence.

15. Disputes

If you have a dispute with us, please first contact us at dartkrux.app.contact@gmail.com so that we can try to resolve it informally. If we cannot resolve the dispute informally, the courts of France will have jurisdiction, subject to applicable consumer protection law.

16. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms is not a waiver of that right.

17. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Material changes will be communicated through the Application or the Application Store at least 30 days before they take effect. Continued use of DartKrux after the effective date of the new Terms means you accept them.
